Minn. Stat. § 176.351, subd. 2 provides:
Acting with or without the written request of an interested party, the commissioner or compensation judge before whom a hearing is held may issue a subpoena for the attendance of a witness or the production of such books, papers, records and documents as are material in the cause and are designated in the subpoena. The commissioner may also issue a subpoena for the attendance of a witness or the production of such books, papers, records, and documents as are material in the cause pending and are designated in the subpoena.
Workers’ Compensation Subpoena Request Steps:
- The party requesting the subpoena shall provide to the assigned Compensation Judge a written statement of the materiality of the testimony or document to be subpoenaed along with the fully completed subpoena. A copy of the request shall be provided to all interested parties, as well as the Court.
- If approved, OAH will then return the completed subpoena to the requesting party for service.
- If denied, the Judge will issue an Order Denying the Subpoena.
