In 2013, the Minnesota legislature directed the Department of Commerce to study Minnesota Statutes section 62A.65, which is the state’s statute requiring guaranteed renewability of health plans in the individual insurance market.

The Minnesota Departments of Commerce and Health (“the Departments”) jointly issue this bulletin to remind, and clarify the requirements for, issuers of Qualified Health Plans (“QHPs”) doing business in Minnesota with respect to the segregation of funds provisions under the Patient Protection and Affordable Care Act, Pub. L. No. 111-148, as amended by the Health Care and Education Reconciliation Act, Pub. L. No. 111-152, and the regulations and guidance issued under the act (collectively, the “Affordable Care Act” or “ACA”).

The Minnesota Departments of Commerce and Health (“the Departments”) are issuing this bulletin to apply to all insurers authorized to write business in the State of Minnesota (the “State”) that may offer dependent coverage. The purpose of this bulletin is to provide guidance related to the State’s enactment of Chapter 74 (House File 1054), which was passed by the Minnesota Legislature on May 13, 2013, signed by Governor Mark Dayton on May 14, 2013, and will become effective on August 1, 2013.

In the interest of providing accurate information to Minnesota consumers in a timely manner, please find the attached joint bulletin requesting that health plan companies seeking to offer policies through MNsure change the effective date of plan filings to September 6, 2013. This will allow the Departments to publicly release final health plan information to Minnesotans sooner than the current effective date designated, October 1, 2013. Consumers will than have an opportunity to fully understand their options and make informed decisions on health insurance plans for themselves, their families and businesses.

In 2013, the Minnesota Legislature enacted Minnesota Statutes chapter 62V that establishes the Minnesota Insurance Marketplace (“MNsure”) as the state health insurance exchange designed to facilitate and simplify the comparison, choice, enrollment and purchase of health plans for individuals and small group employers purchasing health insurance in Minnesota.
